What would happen if you and your fiance moved back in, like permanent 
residents?  He wants to be married, doesn't seem to mind that you are 
sleeping with her, and doesn't want to bother with paperwork, just 
include him on your texas paperwork has her legal spouse.  I have no idea 
whether this is legal, but it could make him a bit crazy.  Especially if 
she uses his name and credit references to get "established".

If there is a separation decree, then he's already in contempt of court 
for refusing visitation.

Of Course he's unmotivated.  He doesn't have to get divorced until HE 
wants to get married!  It doesn't cost him anything to stay married.  You 
can make it uncomfortable by either enforcing the separation decree 
(granting visitation) or by taking full advantage of her status as a 
legally married woman.  My ex ran up about $5000 in new debts just before 
we divorced, mostly buying gifts for her boyfriend.  It didn't take long 
for me to file a separation decree.  We had been "room-mates" for over a 
year (while she dated her fiance).

She can sue him for divorce and custody, as well as property rights.  She 
should ask for alimony, even $20/month, so that she can get more later if 
she needs it (You die...)
